Public Spaces Protection Order (Earls Court) No. 1 of 2024

The Order

This Order is made on 10 April 2024 and will come into force at midnight on 18 April 2024 and will expire at midnight on 17 April 2027

The Activities prohibited by this Order are:

Illegal drugs and psychoactive substances

  • Using or preparing to use illegal drugs or psychoactive substances
  • Failing to comply with a direction to cease the use or preparation of illegal drugs or psychoactive substances;
  • Failing to surrender any items which an Authorised Person reasonably believes to be illegal drugs or psychoactive substances

Littering

  • Abandoning or discarding drugs paraphernalia, bottles, cans, packets, papers, chewing gum, cigarette butts, or similar, other than in an appropriate receptacle or waste/dust bin

Urination/defecation

  • Urinating or defecating in a place other than a serviced public convenience

Alcohol

  • Behaving in a manner which causes harassment, alarm or distress upon the consumption, or suspected consumption of, alcohol;
  • Failing to comply with a direction not to consume, in breach of this order, alcohol, or anything which an Authorised Person reasonably believes to be alcohol;
  • Failing to surrender a container of alcohol (whether open or not) when asked to do so by an authorised person;

Loitering

  • Loitering, whether in group of two or more persons or on your own, where you or the persons in that group (or the group as whole) is causing harassment, alarm or distress

Begging

  • Begging for food, money or other items in a manner which causes harassment, alarm or distress, this includes, but is not limited to: 
    • making repeated requests
    • following a person whilst begging
    • continuing to beg after a negative response has been give 
    • using false or misleading information whilst begging
    • attempting to provide or deliver unrequested or unsolicited services or products accompanied with a demand for money.

Bikes and scooters

  • Riding, cycling or using a bike or scooter on the pavement with the Restricted Area.

Dispersal

  • Remaining in the Restricted Area after having been asked to leave by an Authorised Officer.

Breaching this Order can result in a Fixed Penalty Notice of £100, or on summary conviction in a Magistrates’ Court, a maximum fine of £1,000.

Please note: this telephone number is not a dedicated number solely for PSPO breaches. All calls go through to the Council's contact centre. When all the call agents are busy handling calls, customers will hear an option for a 'call back within an hour', or they can continue in a queuing system until a call agent becomes available.

The Council carried out an Equality Impact Assessment before undergoing the consultation. An Equality Impact Assessment is an improvement process which helps to determine whether the Council’s policies, practices, or new proposals will impact on, or affect different groups or communities. It enables officers to assess whether the impacts are positive, negative or unlikely to have a significant impact on each of the protected characteristic groups.
